Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Quandary ("Quandary", "we", "us") governing your use of the Quandary website and app at quandary.live (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service, and old enough to form a binding contract in your country. By using the Service, you represent that you meet these requirements.

2. Your account

You are responsible for your account and for keeping your login secure. You agree to provide accurate information and to be responsible for all activity under your account. Notify us promptly of any unauthorized use.

3. Your content

You keep ownership of the content you post ("User Content"). By posting, you grant us a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to host, store, reproduce, adapt, publish, publicly display, and distribute your User Content in connection with operating and promoting the Service — including on public pages, in shareable images, in search-engine results, and on social media.

You represent that you have the rights to the content you post and that it does not violate these Terms or any law. This license continues for content that has been shared or made public even after you delete it, to the extent others have shared it or it persists in backups or caches.

4. Acceptable use

You agree not to post or do anything that:

is illegal, harmful, threatening, harassing, hateful, or that promotes violence or discrimination;
is sexually explicit, or sexualizes or endangers minors;
infringes anyone's intellectual-property, privacy, or other rights;
is spam, a scam, malware, or an attempt to disrupt or gain unauthorized access to the Service;
impersonates others or misrepresents your affiliation;
harvests data from the Service or uses it in violation of applicable law.

5. Moderation & termination

We may, but are not obligated to, review, moderate, hide, or remove content, and we may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk. Content reported by multiple users may be automatically hidden pending review. You may stop using the Service and delete your account at any time.

6. Intellectual property

The Service itself — including the Quandary name, logo, design, and software — belongs to us and is protected by law. We grant you a limited, personal, non-transferable license to use the Service. You may not copy, modify, or reverse-engineer the Service except as permitted by law.

7. Copyright / DMCA

We respect intellectual-property rights. If you believe content on the Service infringes your copyright, email hello@quandary.live with: your contact details, identification of the work, the location of the material on the Service, a statement of good-faith belief, and a statement (under penalty of perjury) that the notice is accurate and you are authorized to act. We will respond to valid notices and may remove infringing content and terminate repeat infringers.

8. Third-party services

The Service relies on third-party providers and may link to third-party sites. We are not responsible for third-party services or content, and your use of them may be governed by their own terms.

The following sections limit our liability. They are important — please read them.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that User Content is accurate or reliable. Content on Quandary reflects users' opinions, not ours.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUANDARY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Quandary from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

12. Governing law & disputes

These Terms are governed by the laws of Canada, without regard to conflict-of-laws rules.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and update the "Last updated" date; material changes will be notified by reasonable means. Continuing to use the Service after changes take effect means you accept them.
